    Senior Legal - Dispute Settlement (AfCFTA)

    Purpose of Job

    Provides to resolve disputes in a professional, effective and efficient way, having regard for the law, policies, procedures and good practice.

    Main Functions

    • Manage end to end case work and new matters involving different kind of disputes
    • Assist with the effective management of variable complaint demand by being flexible using a range of dispute resolution processes for high productivity output
    • Provide independent information about how to go about resolving their disputes
    • Accurately record the details of a dispute and case manage according to AU processes
    • Identify key issues arising from a dispute, gather and analyze relevant information (both verbal and written) and decide whether a proposed outcome is in accordance with the law, good practice, and what is fair and reasonable given all the circumstances of the dispute
    • Apply dispute resolution frameworks including conciliations and employ negotiation and problem-solving skills to facilitate the appropriate resolution of disputes

    Specific Responsibilities

    • Serve as secretary to dispute settlement panels and arbitrators in the resolution of trade disputes between AfCFTA States Parties
    • Ensure a dispute settlement process that is transparent, accountable, fair, predictable and consistent with the provisions of the AfCFTA Agreement
    • Facilitate the resolution of disputes through conciliation, good offices, mediation and arbitration
    • Plan and organise the work of the Division
    • Assist and support dispute resolution panels and arbitrators, or members of the Appellate Body considering an appeal
    • Provide substantive legal advice and research on legal, technical or procedural issues in dispute resolution or appeal proceedings
    • Advise the Legal Directorate in the exercise of its functions on dispute resolution issues Perform any other relevant duties assigned by the immediate Supervisor.

    Academic Requirements And Relevant Experience

    • A Master's degree or equivalent in international law (public international law, law of international organizations) with Twelve (12) years of relevant and progressively more responsible experience in the field of legal.
    • Seven (7) of these years should be at senior management level and five (5) should involve a supervisory role

    • Oversee the installation, configuration, maintenance and troubleshooting of key hardware, software and peripherals.
    • Operates at or above the AfCFTA's information technology performance standards
    • Manage all data center hardware and equipment including DC routers, switches, etc
    • Ensures secure operation of all servers and services through the use of security and encryption tools

    • Installs, manages and administers critical databases, which contain confidential corporate information, IP address allocation tables, Ethernet card addresses and other relevant data

    • Manages a complete financial operation, encompassing a wide variety of Member States and Partner Funds, with a large volume of grants in, grants out, implementing partners, and inter-office transactions, and extensive dispersed activities;
    • Manage all aspects of the monthly, quarterly and year-end closure of accounts including development and implementation of detailed closure instructions;
    • Provide expert guidance and advice to management in the area of financial accounting, interpretation and operational guidance on the application of the IPSAS and African Union Financial Rules (AU FR);
    • Acts as AfCFTA focal point and responds to internal/external audit observations and liaises with clients and other relevant entities on audit issues;
    • Lead the development and implementation of new accounting systems. Takes initiative to improve accounting processes and approaches;
    • Coordinate and supervise all accounting transactions including the periodic production of management accounts and IPSAS compliant financial statements;
    • Manage the preparation, implementation and monitoring of the budget;
    • Periodically reviews program budgets to analyze trends affecting budgetary needs. Prepares comparative analyses of programs by analyzing costs and recommendations for budget revisions;
    • Promote best management systems and practices, develop internal controls, as well as ensure transparency and the obligation to justify expenditure.
    • Ensure the proper application of the Financial Rules, Staff Regulations and Rules of the African Union and policies and procedures of management established by AfCFTA.
    • Oversee timely payment of transactions;
    • Maintain an efficient system of policies and procedures that impose an adequate level of control over treasury activities and provide support for regulatory reporting;
    • Liaise and consult with oversight bodies such as Board of External Auditors, Office of Internal Oversight and Policy Organs to ensure implementation of their recommendations as appropriate;
    • Supervises and manages the Division's staff in terms of organization and performance evaluation;
    • Coordinate risk management activities across AfCFTA;
    • Perform any other relevant duties assigned by the immediate Supervisor.

    Academic Requirements And Relevant Experience

    • Master’s degree in Business Administration, Finance, Accounting or related field with 12 years progressive responsible experience in managing finance functions out of which 7 at managerial level and 5 years at supervisory level.
    • A professional qualification such as CPA, CA, ACCA, CIMA, Expert Comptable or equivalent is an added advantage;
    • Previous experience in establishing functional Finance Function (Accounting, Budget and Disbursement/Treasury) is required;
    • Working experience with International Public Sector Accounting Standards (IPSAS) and financial statement preparation (general and special purpose) in large international organization is required;
    • Demonstrate high level understanding of budgetary process, management of Development Partner’s funds and relationships;
    • In-depth understanding and experience in developing financial rules/policies, managing risk and implementing effective internal controls,
    • Hands-on experience working with enterprise resources management (ERP) systems, particularly SAP is an asset;

    Head of Division Customs Capacity Building and Training (AfCFTA)

    Purpose of Job

    Responsible for the development of Customs Services through the implementation of AfCFTA Conventions, guidelines and tools.

    Main Functions

    • Collaborate with States Parties on strategies and priorities in the areas of capacity building, training and technical assistance
    • Work with stakeholders to ensure Customs effectiveness through capacity building tools, instruments and initiatives
    • Oversee and regularly review Customs capacity building activities, including the dissemination of Customs best practices
    • Develop a public-private partnership to build the capacity of Customs in States Parties

    Specific Responsibilities

    • Is Responsible for all capacity building activities assigned by Customs Director.
    • Develop and maintain guidance, tools and Customs AfCFTA programmes.
    • Performs any other duties that may be assigned and/or required by the Director
    • Leads and advises on policy and programme development for capacity building
    • Develops and maintains a close working relationship with the other Directorates of the AfCFTA to efficiently share resources, manage workload and co-ordinate the cross-cutting

    work and activities.

    • Provides strategic development advice to Members and represents the Secretariat/Capacity Building division at appropriate meetings.

    Academic Requirements And Relevant Experience

    Master's degree in international business, development economics, international relations, international trade, international law, political science or relevant disciplines with Twelve (12) years of relevant experience at increasingly senior levels in the field of corporate communications. Seven (7) of these years should be at the senior management level and five (5) should involve a supervisory role.

    TENURE OF APPOINTMENT:

    The appointment will be made on a regular term contract for a period of three (3) years, of which the first twelve months shall be considered as a probationary period. Thereafter, the contract will be for a period of two years renewable, subject to satisfactory performance and deliverables.

    Purpose of Job

    Responsible for the operations of the entire directorate/department. Plan, develop and implement strategic policies while promoting inter- directorate/department collaboration. Provide technical and strategic advice to the Secretary General and to the AfCFTA Institutions.

    Main Functions

    • Develop and maintain operating rules and procedures.
    • Provide technical leadership and ensure efficient functioning of all Divisions.
    • Ensure overall management of the directorate/department personnel, budget, performance, quality, discipline and training in conformity with relevant rules and procedures in force.
    • Determine and execute the overall strategy of the directorate.
    • Develop and oversee policy development guidelines.
    • Prepare and oversee integrated programmes of overall activities of the directorate.
    • Build and maintain a strategic plan to form good working relations with other directorates/departments.
    • Develop and maintain regular working relations with top level stakeholders in appropriate agencies of Member States and partners.
    • Organize coordination meetings between the organization and other relevant organizations.
    • Ultimately responsible for preparing periodic financial and budget execution reports and annual financial statements and other reports.
    • Promote awareness and training of best practices in area of expertise.

    Specific Responsibilities

    • Develop Strategic Framework, Standard Operation Procedures that enhance trade facilitation and enforcement for Customs Cooperation
    • Engage with State Parties, stakeholders and partners on custom matters and the implementation of trade facilitation measures
    • Coordinate State Parties towards building efficient customs procedures, trade facilitation and transit systems
    • Liaise with relevant national bodies on Custom cooperation and mutual administrative assistance
    • Spearhead the establishment of modern data processing systems to facilitate effective and efficient custom operation and transmission of trade data
    • Lead the Secretariat services for Directors-General/ Heads of Customs Committee and the Sub-Committee on Trade Facilitation, Customs Cooperation and Transit and other relevant meetings on Customs
    • Monitor and report on the implementation of the customs-related provisions of the AfCFTA Agreement including the Annexes on Customs Cooperation, Trade Facilitation and Transit, administration of Rules of Origin, and resolution of related non-tariff barriers
    • Lead activities related to the establishment of the African Continental Customs Union
    • Determine and execute Directorate strategy and align to the AfCFTA overall Strategy

    Academic Requirements And Relevant Experience

    • University Master’s degree in international trade, development economics, international relations, international business, international law, Political Science or relevant discipline A minimum of fifteen (15) years of progressively responsible professional work experience in professions related to Customs Administration, Trade Facilitation, Transit, Administration of Rules of Origin, and Resolution of related Non-Tariff Barriers, at national, regional economic community, continental or international level
    • out of which eight (8) years should be at managerial level managing professional staff in support of or within a national, regional, continental, or international institution.
